The Illinois Department of Healthcare and Family Services (IDHFS) is an administrative agency that is separate from the domestic relations courts. The IDHFS has the power to declare parentage, order child support payments, modify child support, and take enforcement action to ensure payment of support.
Parents have a right to request an accounting of all payments received by the IDHFS and may dispute the accounting when there is a discrepancy between the amount previously paid and the IDHFS’ record of payment. Often disputes arise after a lien is placed on property, tax refunds are intercepted, passport renewals are denied, or other enforcement actions are taken by the agency.
Unfortunately, sometimes modifications to child support made by the domestic relations courts or the IDHFS are not reflected in the records of the other.
